FERPA
Many states and other organizations that support the Data Quality Campaign have reported that the federal Family Educational Rights and Privacy Act (FERPA) has been interpreted and applied in a manner that has had a significant chilling effect on the willingness of states to develop robust state longitudinal data systems as a necessary foundation for standards-based reform. In particular, FERPA imposes limits on the disclosure of student records by the educational agencies and institutions that receive funds from the U.S. Department of Education. The DQC looks forward to providing forums for these conversations within and across states to inform sound policy decisions that support using longitudinal data to improve student achievement while also protecting individual student privacy. This issue analysis may serve as a guide to assist states as they build and use state longitudinal data systems in ways that comply with FERPA and fully protect the privacy rights of students and their parents.
This analysis addresses changes that are still needed to accommodate the functions of state longitudinal data systems and how best to make the changes. As of May 2010, the DQC is working collaboratively to update this document.
